The writ petition has been filed by the Dhanya Club, Mele Kodakkad (the Club), which is a society that is registered under the Societies Registration Act XXI of 1860. The club was formed with the objective of encouraging the participation of youth in games, promoting social and cultural activities, and providing recreational indoor and outdoor facilities, which, amongst others, include the game of rummy. The entry to the club is restricted to only its members. The first respondent (The Superintendent of Police, Palakkad) issued an oral direction to the petitioner not to allow its members to play rummy. According to the petitioner, despite assurance by the petitioner that the society does not function as a common gaming house, the respondent was adamant in his stance and threatened to register a case against the members. The petitioner has, therefore, filed this writ petition seeking inter-alia a direction to the respondents to refrain from interfering with the activities of the club and its members, including the playing of rummy on its premises.
