In the result, this appeal is allowed. The award dated 11.04.2012 passed by the Motor Accidents Claims Tribunal, Thrissur in O.P.(MV).No.1836 of 2004 by dismissing the said claim petition is hereby set aside and it is held that the claim submitted by the appellant is maintainable under Section 163A of the Motor Vehicles Act. The quantum of compensation is fixed as Rs.54,512/[Rupees fifty-four thousand five hundred and twelve only]. Respondents 1 to 3, being the owner, driver and the insurer are held jointly and severally liable to pay the compensation. Since the coverage of the policy is admitted by the 3rd respondent, the 3rd respondent is directed to deposit Rs.54,512/- [Rupees fifty-four thousand five hundred and twelve only] along with interest at the rate of 8% per annum from the date of petition till realization and with proportionate costs, within three months from the date of receipt of a copy of this judgment. However, it is clarified that, as the delay of 600 days in filing the appeal was condoned by this Court, subject to the condition that the appellant shall not be entitled for interest for the compensation pertaining to the period of delay, the 3rd respondent shall be entitled to exclude the period
