This revision is initiated under Section 397 read with Section 401 of the Code of Criminal Procedure, 1973 against an order dismissing a petition for setting aside the exparte order. That petition dismissed for default in payment of costs.

learned counsel for the petitioner as well as the learned counsel for the 2 nd respondent would submit that the matter was settled out of court.
