The prayers in this Writ Petition are as follows:

“a) issue a writ of certiorari or any other appropriate writ, or order quashing Ext.P7 order now passed by the 3^rd respondent on Ext.P3 application submitted by the petitioners;

b) issue a writ of mandamus or any other appropriate writ, order or directions, directing the 3^rd respondent or appropriate authority to pass appropriate orders afresh on Ext.P3 application, after verifying relevant records, evidences and facts about the violation of Building Rules, prescribed for Floor Space Index, set-offs in frontage and other sides, parking spaces, fire protection measures etc., and also the violations of law under Kerala Conservation of Paddy Land and Wet Land Act, 2008;

c) issue a writ of mandamus or any other appropriate writ, order or directions, directing the respondents to pass fresh appropriate orders on Ext.P3 applications as expeditiously as possible, in accordance with law;

d) pass orders that are deem fit and proper in the facts and circumstances of the case.”

2. The petitioners are the residents of Kozhikode Municipal

¶34

Corporation in Othayamangalam Road, a residential zone, classified in

the Master Plan for the Kozhikode Urban Area, 2035. An auditorium complex named as ‘Ashirwad Lawns’ owned by Sri.C.V.Balan and others and a hotel by name ‘Aiswarya Arcade’ owned by Smt.Preethi Prajod and Smt.Deepa Balan, were constructed allegedly in violation of the Kerala Municipality Building Rules. The petitioners filed a complaint before the Enquiry Commissioner and Special Judge, Kozhikode. The Special Judge forwarded the complaint to the Vigilance and Anti-Corruption Bureau under Section 156(3) of Cr.P.C directing registration of crime and investigation. That order was challenged before this Court in W.P(C) No.510/2022. As per Ext.P2 judgment this Court held that the Special Court could not have forwarded the complaint under Section 156(3) of Cr.P.C for investigation without any sanction under Section 19(1) of the Prevention of Corruption Act, 1988 (for short ‘the PC Act), in view of the law declared by the Apex Court in Anil Kumar and others v. M.K.Aiyappa and another (2013 KHC 4790) and this Court set aside the order directing registration of the crime and investigation. However, the Court below was directed to proceed with the complaint in accordance with law, after getting sanction from the competent authority under Section 19 of the PC Act.

The petitioners, thereafter, approached the competent

authority for according sanction as provided under Section 19(1)(i) of the PC Act. The competent authority of the Government considered

the application and passed Ext.P7 order. The relevant portion of the order reads thus:

“4. പ്ര�ാഥമിക അന്വേ��ഷണത്തിൽ ന്വേകരള മു�ിസിപ്പൽ കെകട്ടിട �ിർമ്മാണ ചട്ടങ്ങൾ പ്ര�കാരം വിവിധ ചട്ടങ്ങളുകെട ചില ലംഘ�ങ്ങൾ കെകട്ടിട �ിർമ്മാണവുമായി �ടന്നിട്ടുകെ&ങ്കിലും , ബന്ധകെപ്പട്ട അന്വേ�ക്ഷ അ�ുബന്ധ പ്ലാ�ുകൾ എന്നിവയും, ഒക്യുകെ�ൻസി സർട്ടിഫിക്കറ്റി�് �ൽകിയിട്ടുള്ള ഫയലുകളും ന്വേ�രിട്ടും, ഫയലുകളുകെട കെവളിച്ചത്തിൽ കെകട്ടിടം സ്ഥിതികെചയ്യുന്ന സ്ഥലവും സൂകഷ മമായ �രിന്വേ:ാധ�യ ് ് ക്ക വിന്വേധയമാക്കുന്ന മുറയ ് ക്ക മാപ്രതന്വേമ �ിയമലംഘ�ത്തികെ= ന്വേതാത് കൃത്യമായി �ിർണ്ണയിക്കാൻ കഴിയുകയുള്ളുകെവന ് ന �രാമർ:ം 5 ( ) പ്ര�കാരം ചിഫ് എൻജി�ീയർ . അറിയിച്ചിട്ടു&് ബന്ധകെപ്പട്ട ഫയലുകൾ അന്വേ��ഷണാവ:്യാർത്ഥം വിജിലൻസ് & ആ=ികറ�്ഷൻ ബ്യൂന്വേറായുകെട കസ്റ്റഡിയിലാണ് . 5. സർക്കാർ ഇക്കാര്യം വി:ദമായി �രിന്വേ:ാധിച്ചതിൽ ന്വേകസികെ= സത്യാവസ്ഥന്വേയാ ന്വേപ്ര�ാസിക്യൂഷൻ ആവ:്യകെപ്പടുന്ന ഉന്വേദ്യാഗസ്ഥരുകെട ഭാഗത്തുള്ള �ങ്കാളിത് ികെ= അളന് വ ാ വിലയിരുത്താകെത ഈ സമയത ് ത ഹർജിക്കാർ ആവ:്യകെപ്പടുന്ന ന്വേപ്ര�ാസിക്യൂഷൻ അ�ുമതി �ൽകുന്നത് ഉചിതമകെOന്നും ആയത് സ�ാഭാവിക �ീതിയുകെട തത�ങ്ങൾക ് ക എതിരാകെണന്നും കാണുന്നു . ന്വേമൽ സാഹചര്യത്തിൽ �രാമർ:ിത വിഷയവുമായി ബന്ധകെപ്പട ് തന്വേP:സ�യംഭരണ വകുപ ് പ ഉന്വേദ്യാഗസ്ഥരായ ശ്രീ.ജയൻ , സൂപ്ര�&ിംഗ് എഞ്ചി�ീയർ (റിട്ട), ശ്രീ.മുഹമ്മദ് അഷ്റഫ്, സൂപ്ര�&ിംഗ് എഞ്ചി�ീയർ (റിട്ട), ശ്രീ.സന്വേ�ാജ്, ഓവർസിയർ, ടൗൺ പ്ലാ�ിംഗ് , . ജലജാറാണി, വകുപ ് ശ്രീമതി.വി.ഡി സൂപ്ര�&ിംഗ് എഞ്ചി�ീയർ (റിട്ട), ശ്രീ.ബി�ു പ്രഫാൻസിസ്, ന്വേകാർപ്പന്വേറഷൻ കെസപ്രകട്ടറി എന്നീ ജീവ�ക്കാർകെക്കതികെര അഴിമതി �ിന്വേരാധ� �ിയമം 19(1 ) പ്ര�കാരം ന്വേപ്ര�ാസിക്യൂഷൻ അ�ുമതി �ൽകണകെമന്ന �രാമർ:ം 3( ) പ്ര�കാരമുള്ള ആവ:്യം �ിരസിച്ചുകെകാ&് ഇതി�ാൽ ഉത്തരവ് �ുറകെപ്പടുവിക്കുന്നു .”

The petitioners challenge Ext.P7 order in this Writ Petition.

Heard the learned counsel for the petitioners and the

learned Special Government Pleader (Vigilance).

The learned counsel for the petitioners submitted that the

¶50

sanctioning authority has not applied its mind while considering the application for sanction. It is evident from Ext.P7 that the sanctioning authority has not considered the relevant records. The authority should have obtained the relevant records from the Vigilance and AntiCorruption Bureau and from the local authority concerned. Ext.P7 order makes it clear that the sanctioning authority has not taken into account any of the relevant records while declining sanction. The Vigilance and Anti-Corruption Bureau submitted the preliminary enquiry report. The Vigilance and Anti-Corruption Bureau recorded a series of irregularities committed by the various officials of the local authority. The conclusions of the Vigilance and Anti-Corruption Bureau are the following:

“1)റവ�്യൂ അധികാരികളിൽ �ിന ് ന ഭൂമിയുകെട തരം മാറ്റിയ സർട്ടിഫിക്കറ ് റ ലഭ്യമാകാകെത തകെന്ന �ില ഭൂമിയിൽ കെകട്ടിട �ിർമാണാ�ുമതി(കെ�ർമ്മിറ ് റ ) �ൽകിയതായി കാണുന്നു . 2)�ിയമാ�ുസൃതമOാകെത ന്വേ�ാട്ടറി അറ്റസ്റ്റു കെചയ്ത അഫിഡവിറ ് occupancy മാപ്രതം അടിസ്ഥാ�മാക്കിയാണ് അ�ുവദിച്ചകെതന്നും, ആയത് അഫിഡവിറ്റിൽ സൈസറ ് റ പ്ലാൻ ഉൾകെപ്പടുത്തിയിട്ടികെOന്നും ആയതുകെകാ&ു തകെന്ന ബാലൻ എന്നവരിൽ �ിന്നും എപ്രത Extend of land ആണ് കൂടുതലായി ഉ�ന്വേയാഗകെപ്പടുത്തിയത് എന്നതികെ� സംബന്ധിച ് ച വ്യക് യുമികെOന്നും ഭൂമിയുകെട ഔന്വേ�ർഷി�് ന്വേരഖകളും ഹാജരാക്കിയതായി കാണുന്നികെOന്നും കംപ്ലീഷന്വേ�ാകെടാപ്പം സമർപ്പിച്ച സൈസറ ് റ പ്ലാ�ിൽ ഉടമകന്വേളാ ന്വേ�ാട്ടറിയായ ന്വേഗാ�ി�ാഥ് കെക

എന്നിവരാരും തകെന്ന ഒപ ് പ കെവച്ചിട്ടിO എന്നുമുള്ള കാര്യങ്ങൾ കെവളിവാകുന്നു .

3 ) ബിൽഡിംഗ് സൈഹറ്റിൽ വന്ന വ്യതിയാ�ം സൈഫ�ൽ Fire NOC �ൽകുന്ന ന് വ ളയിൽ �രിഗണിച്ചിട്ടികെOന്നു കാണുന്നു .

4)KMBR Rule 26 പ്ര�കാരം ഓപ്പൺ സ്ന്വേ�സ് 3.00 മീറ്റർ എOായിടത്തും ഉ&ായിരിന്വേക്ക&താകെണന്ന �ിബന്ധ� �ാലിക് ക പ്പട്ടിട്ടിO.

വാഹ� �ാർക്കിംഗി�ായുള്ള സ്ഥലത ് ത �ിലവിൽ പ്രടാൻന്വേ`ാർമർ സ്ഥാ�ിച്ചതു ന്വേ�ാകെല പ്രകമരഹിത �ിർമ്മാണം �ടത്തിയതി�ാൽ ടി സ്ഥലത ് ത വാഹ�ം �ാർക ് ക കെചയ്യാൻ സാദ ് ധമOാത് ി�ാൽ ചട്ട ലംഘ�ം �ടന്നതായി കാണുന്നു . 6)KMBR Rule 24(10) പ്ര�കാരം യാകെതാരു തരത്തിലുള്ള �ിർമ്മാണങ്ങന്വേളാ കെപ്ര�ാജക്ഷൻന്വേസാ ന്വേപ്ലാട്ടതിർത്തിക ് ക �ുറത ് അ�ുവദ�ീയമകെOന്നുള്ള �ിബന്ധ� �ാലിക് ക പ്പട്ടിO.

Global Distributors മായി അതിർത്തി പങ്കിടുന്ന പടിഞ്ഞാറു ഭാഗത ് ത പെപർമിറ ് റ ഫയലിൽ 16.40 M. കാണിക്കുന്നുപെ0ങ്കിലും ഒക്യുപെപൻസി പ്ലാനിൽ ആയത് (15.03 +0.58) = 15.61 M ആണ്. എന്നാൽ സ്ഥല �രിന്വേ:ാധ�യിൽ ലഭ്യമായത് 14( .34+.45)= 14.79 M . ഈ മാപ്രതമാണ് വ്യതിയാ�ം സംബന്ധിച ് യാകെതാരു വി:ദീകരണങ്ങളും ഫയലിൽ ന്വേരഖകെപ്പടുത്തി കാണുന്നിO 8)KMBR ചട്ടം 6(a)(i) പ്ര�കാരം കെ�ർമിറ്റി�ായി അന്വേ�ക്ഷിക്കുന്വേdാൾ സമർപ്പിന്വേക്ക& സൈസറ ് റ പ്ലാ�ിൽ അന്വേ�ക്ഷകകെ= സൈകവ:മുള്ള കെതാട് ട ത്ത ന്വേപ്ലാട്ടുകളുകെട വി:ദാം:ങ്ങൾ കൂടി ഉൾകെപ്പടുത്തി സമർപ്പിന്വേക്ക&താകെണന്നിരികെക്ക കെ�ർമിറ ് അ�ുവദിക്കുന്ന ന് വ ളയിന്വേലാ ഒക്യുകെപ്പൻസി �ൽകുന്ന അവസരത്തികെലാ ഈ കാര്യം �ാലിച്ചിട്ടിO.

ഓഡിറ് റ ാറിയത്തിപെE Rear side Open space ൽ ഷീറ ് നിർമ്മാണം നടത്തി wash Area ആയി ഉപറ്റയാഗിച ് ച ചട്ടലംഘനം നടത്തിയിരിക്കുന്നു .

10)�ിയമാ�ുസൃത കെ�ർമിറ്റിOാകെത ന്വേപ്ലാട്ടികെ= വടക്കു ഭാഗത്തായി ജയശ്രീ ബാലൻ എന്നിവരുകെട ഉടമസ്ഥതയിലുള്ള സ്ഥലത ് ത 35.5 മീറ്റർ �ീളവും 23.67 മീറ്റർ വീതിയിലും Ground + 2 �ിലകളിലായി structure work �ടത്തി ചട്ട ലംഘ�ം �ടത്തിയിരിക്കുന്നു .

�ിർമ്മാണത്തികെല പ്രകമന്വേക്കടുകകെള സംബന്ധിച്ച �രാതിയുമായി ബന്ധകെപ്പട ് ട ഫയൽ �ഷ്ടകെപ്പടുത്തിയ ഉന്വേദ ് ധഗസ്ഥ= ന്വേ�രിൽ �ട�ടികൾ സ�ീകരിച്ചതായി കാണുന്നിO.”

The sanctioning authority has not even taken into account

the report of the Vigilance and the documents collected during the preliminary enquiry. It has not applied its mind to the relevant records while considering the application seeking sanction. On the application of mind by the sanctioning authority, the Apex Court in State of

Karnataka v. Ameerjan [(2007) 11 SCC 273] held thus:

“10…...Ordinarily, before passing an order of sanction, the entire records containing the materials collected against the accused should be placed before the sanctioning authority. In the event, the order of sanction does not indicate application of mind as (sic to) the materials placed before the said authority before the order of sanction was passed, the same may be produced before the court to show that such materials had in fact been produced.”

8. In State of Maharashtra v. Mahesh G.Jain [(2013) 8 SCC

¶69

119] the Apex Court held thus:

"14.1. It is incumbent on the prosecution to prove that the valid sanction has been granted by the sanctioning authority after being satisfied that a case for sanction has been made out.

¶71

14.2. The sanction order may expressly show that the sanctioning authority has perused the material placed before it and, after consideration of the circumstances, has granted sanction for prosecution.

14.3. The prosecution may prove by adducing the evidence that the material was placed before the sanctioning authority and its satisfaction was arrived at upon perusal of the material placed before it.

14.4. Grant of sanction is only an administrative function and the sanctioning authority is required to prima facie reach the satisfaction that relevant facts would constitute the

offence.

14.5. The adequacy of material placed before the sanctioning authority cannot be gone into by the court as it does not sit in appeal over the sanction order.

¶78

14.6. If the sanctioning authority has perused all the materials placed before it and some of them have not been proved that would not vitiate the order of sanction.

14.7. The order of sanction is a prerequisite as it is intended to provide a safeguard to a public servant against frivolous and vexatious litigants, but simultaneously an order of sanction should not be construed in a pedantic manner and there should not be a hypertechnical approach to test its validity.”

The position of law that emerges from the above discussion

is that the sanctioning authority ought to have applied its mind to the

relevant materials. The authority ought to have called for the relevant records from the local authority and the Vigilance and Anti-Corruption

¶83

Bureau.

The resultant conclusion is that Ext.P7 is liable to be set

¶85

aside.

¶86

In the result, Ext.P7 order stands set aside. The competent

¶87

authority under Section 19 of the PC Act shall reconsider the request for sanction submitted by the petitioners and pass appropriate orders, in accordance with law, after taking into account the entire materials.

When the dictation of the judgment reached here, the learned Special Government Pleader (Vigilance) submitted that there is

a doubt as to whether respondent No.3 is the competent authority, as

far as the respondents in the complaint are concerned. I make it clear

that, if it is found that respondent No.3 is not the competent authority

to grant sanction under Section 19(1) of the PC Act, the petitioners are at liberty to approach the competent authority concerned. The petitioners are also at liberty to produce the relevant documents before the competent authority.

The Writ Petition is allowed as above.
