JUDGMENT

Petitioners are the stage carriage operators in Alappuzha District, who have approached this Court seeking directions to the 1^st respondent to consider Ext.P1 representation submitted by the 1^st petitioner for temporary deviation for the stage carriage services via. Azhikodan junction - Muttathiparambu junction – Puthanangady Theatre Junction – Punthanangady, till the original road portion become fit to conduct service.

It is contended that all the services are to proceed via. Muttathiparambu-Azhikodan Junction and the road portion PalutharaPuthanangady is in a dilapidated condition and the culverts situated on the route are damaged heavily and not fit for vehicular traffic. Thus, 2.15 kms on the sector is totally unfit. In this regard, had submitted an application for temporary variation dated 7.6.2022, Ext.P1, which is stated to be pending before the Joint Regional Transport Officer, Cherthala.

Learned counsel for the respondents submitted that the authority would not be averse in taking a call on the representation, in accordance with law.

Without expressing any opinion on the merits of the matter, I dispose of the writ petition with a direction to the respondent to take a call on the representation Ext.P1 and decide the same in accordance with law, within a period of one month from the date of receipt of a certified copy of this judgment.
