This writ petition is filed with the following prayers:-
“(i) Call for the records leading to the issuance of Ext. P-4 order and P-5 notice and issue a writ of Certiorari or any other appropriate writ, order or direction quashing Ext. P-4 and P-5.
(ii) Issue a Writ of Mandamus or any other appropriate writ, order or direction directing the 1st respondent to enquire the matter afresh after giving the petitioner opportunity file counter and evidence in the matter and reconsider Ext. P-4 order within a time frame decided by this Hon’ble Court.
(iii) Issue such other writ or direction which this Hon’ble Court may deem fit and proper on the facts and circumstances of the case and in the interest of justice.” (SIC)

to construct a retaining wall on the side of the road to protect the property of the 5th respondent. Ext.P4 is the order passed by the District Collector invoking the powers of the Chair Person, District Disaster Management Authority. Aggrieved by the same, this writ petition is filed.
“The 3rd respondent will inspect the disputed property mentioned in Exhibit P4 with notice to the petitioner and 5th respondent and submit a report before this court within one week from the date of receipt of the order. The 3rd respondent will also submit a report about the necessity of the retaining wall.
Issue a copy of this order to the learned Government Pleader today itself.

In the light of the above report, I am not in a position to interfere with Ext.P4 order. In Ext.P4 and also in the report submitted by the Village Officer, it is clearly stated that, unless there is a retaining wall, there is danger to the residential house of the 5th respondent. In such circumstances, I am not in a position to interfere with Ext.P5 order. The writ petition fails and the same is dismissed.
