J U D G M E N T

1. The Writ Petition is filed under the Article 226

¶24

of the Constitution of India, seeking the following prayers.

¶25

“a. To issue a writ of mandamus or any other appropriate writ, order or direction commanding the competent among respondent to provide all statutory service to the petitioner and to renew the goods carriage permit, fitness certificate and also to remit the tax in respect of petitioner’s vehicle bearing Registration No. KL-40-P-5327.

b. To issue a writ of mandamus or any other appropriate writ, order or direction commanding the competent among respondents not to insist NOC from the financier for the renewal of goods carriage permit or for the remittance of tax in respect of the petitioner's vehicle bearing Registration No. KL-40-P-5327; and

c. Grand such other reliefs which this Hon’ble

Court may deem fit and proper in the interest of justice.”

The Learned Government Pleader submitted that,

the petitioner has not submitted an application for renewal of permit of the vehicle bearing Registration No. KL-40-P5327. The competent authority for renewal of the permit is Sub Regional Transport officer, Perumbavoor. Considering the aforesaid submission, the present writ petition is disposed of with liberty to the petitioner to move an appropriate application before the Sub Regional Transport officer, Perumbavoor within a period of 10 days for renewing the permit of the petitioner.

The Sub Regional Transport officer, Perumbavoor shall decide the application in accordance with

law along with the prescribed fees within a period of 15 days

thereafter.
