The petitioner studied B.Sc Statistics course in the 4^th respondent college for the academic year 2020-2023. The petitioner passed all subjects in semesters 1 to 4 with an aggregate mark of 70%. But she failed for the subject ‘Mathematical Methods in Statistics’ in the 5th semester examination. She obtained the internal mark of 12 and she could obtained only 13 in the external mark. The required external mark to pass the subject is 19. Therefore, the petitioner applied for revaluation of the said subject.

The petitioner filed Ext.P3 representation before the

2^nd respondent to consider her request expeditiously.

A statement has been filed by respondents 1 to 3,

wherein it is specifically contended that the 2^nd respondent does not have jurisdiction to take up Ext.P2 representation and pass orders. Thereafter, the petitioner filed I.A No.1/2023 and produced another representation as Ext.P4 to the Vice Chancellor, Kannur University, seeking the same relief as in Ext.P3. The counsel for the petitioner submits that Ext.P4 may be directed to be disposed of by the competent authority.

The Standing Counsel for respondents 1 to 3 submits

that if Ext.P4 is pending, the same shall be disposed of in accordance with law.

Taking note of the stand taken by the respondents, I direct the 2^nd respondent to forward Ext.P3, which is pending before the 2^nd respondent to the Vice Chancellor, Kannur University, and the Vice Chancellor shall consider Ext.P3 as well as Ext.P4

in accordance with law, and pass appropriate orders within a period of six weeks from the date of receipt of a copy of the judgment.
