The petitioner is the owner of 4.80 acres of property in Re.sy. Nos.89/3 and 88/8 in Block 132 & Old Sy. No.31/part of Kurumathoor Village, Thaliparambu Taluk, obtained as per Ext.P1 sale deed. The petitioner purchased the said property from one Appukuttan Nair who obtained the said property by virtue of Ext.P2 purchase certificate. Pursuant to Ext.P1 sale deed, the petitioner had effected mutation and is remitting tax as evident from Ext.P3 tax receipt. However, when the petitioner proposed to sell the property covered by Ext.P1, it was brought to her notice that, in view of Ext.P4 proceedings, there is prohibition for registration of the sale of the property owing to a ceiling case referred to therein. The petitioner submits that her property is not involved in any land ceiling case. She relies on Ext.P5 judgment wherein this Court has, in similar circumstances, held that there cannot be any prohibition to register documents for sale and the right of the State to initiate action is always available, even if the registration is effected and this Court directed the concerned Sub Registrar therein to register the document for sale which may be presented by the petitioner after
