The petitioner is the accused in C.C.No.770 of 2022 on the files of the Judicial First Class Magistrate Court-II, Alappuzha (for short 'the court below').

The offences alleged against the petitioner are punishable under Sections 406, 420 and 354 of IPC.

The petitioner is at present abroad. Summons has already been issued to the petitioner to appear before the court below on 06.03.2023. However, the learned counsel for the petitioner submits that at the instance of the 2^nd respondent, a Blue Corner Notice has been issued against the petitioner.

The learned counsel for the petitioner submits that the petitioner is prepared to come down to India and appear before the court below on 06.03.2023. However, since Blue Corner Notice is pending, the petitioner apprehends that he will be arrested. It is in these circumstances, the petitioner has approached this Court.

Having heard Sri.P.Arun Kumar, the learned counsel for the petitioner and Sri.P.G.Manu, the learned Senior Public Prosecutor, this Crl.M.C. is disposed of as follows:

(i) The petitioner shall appear before the court below on 06.03.2023 and offer bail.

¶27

(ii) The court below shall dispose of the bail application on the same day itself in accordance with law.

¶28

(iii) The Blue Corner Notice issued against the petitioner shall be kept in abeyance till the bail application is disposed of.
