The appellant, who was the first accused in S.C.No.41
of 2014 of the Special Judges Court (NDPS Act Cases), Vatakara, stands convicted and sentenced to rigorous imprisonment for 15 years and fine of Rs.1,00,000/- for the offences under Sections 22(b), 22(c) and 29 of the Narcotic Drugs and Psychotropic Substances Act.
The accused, two in number, while travelling in a KSRTC Super Express bus at about 9.45 p.m. on 27.08.2012 was found to be in possession of 10 numbers of Diazepam Injection IP (dizep) ampules, 80 numbers of Buprenorphine Injection IP Lupijesic and 15 numbers of Phenergan Hydrochloride Injection by the Excise Enforcement and Anti Narcotic Special Squad. On chemical analysis, Diazepam and Buprenorphine included as item nos. 194 and 164 in the schedule of the NDPS Act.
