enjoy the benefits of the judgment of the learned Single Judge in O.P.(DRT) No.89/2014. It is evident from the judgment in W.A. No.1896/2014 that the direction to deposit Rs.25,00,000/- was on the basis of the submission made on behalf of the petitioner before the court that such deposit would be made. The petitioner thereafter approached the Supreme Court and the Supreme Court by Ext.P3 order in S.L.P. No.10129/2015 granted further time upto 30.04.2015 to pay the amount of Rs.25,00,000/- as directed by the Division Bench of this Court in Ext.P2 judgment. Still later, the petitioner filed W.P.(C) No.23556/2015 before this Court where it is the specific statement of the petitioner that the petitioner requires only two months time to clear the entire liability. Taking into consideration the aforesaid submission of the petitioner, this Court directed the petitioner to approach the Bank with a request for grant of time. The judgment in W.P.(C) No.23556/2015 was pronounced on 05.08.2015. The petitioner is now faced with action under the provisions of the SARFAESI Act to take physical possession of the secured assets.
