The petitioner states that he is a contractor engaged in contract works. The 2nd respondent invited tenders for carrying out the construction of the sidewall of a channel from Kalari Temple Junction to Panickal Thodu within the territorial limits of Elampalloor Grama Panchayat for the financial year 2015-2016. The petitioner states that the tender was accepted and he was required to deposit 20,500/by way of security and Rs.90,000/-as performance guarantee. He contends that an agreement was entered into and the amounts were deposited. However, when work commenced, there were objections from persons residing on either side of the channel. The petitioner was thus prevented from executing the work. He was then served with Ext.P5 notice issued by the 1st respondent asking him to show cause why the agreement shall not be revoked and the security amount forfeited. Though the petitioner issued a reply, the 2nd respondent issued Ext.P7, proceeding cancelling the agreement and forfeiting the amounts deposited. It is in the afore circumstances that this writ petition is filed seeking to quash Ext.P7 order and for further direction to the 2nd respondent not to encash the security deposit and for ancillary reliefs.
