W.P.(C) No.4431 of 2021 is filed by Smt.Merlin K.U, a Pre-primary Teacher working in GUPS, Pinangod, seeking to quash Ext.P8 order issued by the Government ordering the reappointment of certain Siji M.P., the petitioner in W.P.(C) No. 8792/2020. The petitioner has also sought a declaration that Ext.P8 order insofar as it orders the reappointment of a teacher, who has resigned from service after cancelling the valid appointment granted to the petitioner, cannot be sustained under law.

W.P.(C) 8792 of 2021 is filed by Smt.Siji M.P, seeking to quash

Ext.P25 order issued by the Headmaster of Government UP School, Pinangod, as per which she has been informed that in view of the interim order granted

by this Court in W.P.(C) No.4431 of 2021, it would not be possible to reappoint her as ordered by the Government.

As common issues are involved, these writ petitions are taken up and disposed of by a common judgment.

The brief facts of the case are as under:-

a) By a Government Order No.3032/2017 dated 26.08.2017

(produced as Ext.P8 in W.P.(C) No.8792 of 2021), Siji M.P was appointed as a

Pre-primary teacher, considering her previous experience. It was mentioned in the said order that the approval of the appointment of Smt.Siji is granted as a special case, and she would be entitled to an honorarium.

b) On the strength of the orders issued by the Government, Smt.Siji continued to work as a Pre-Primary teacher for the period from 12.06.2017 to 15.11.2020. While so, Smt. Siji applied for leave from the school for the period from 12.11.2020 to 16.12.2020 for contesting elections to the Grama Panchayat. On receipt of the application for leave, the Headmaster sought permission from the AEO for appointing another teacher. When leave was not sanctioned, Smt. Siji submitted an application for resignation on 16.11.2020. The letter submitted by the petitioner was forwarded by the Headmaster to the AEO.

c) Smt.Siji did not get elected to the Grama Panchayat. Immediately thereafter, Smt.Siji M.P. submitted a letter dated 21.12.2020 (produced as Ext.P4 in W.P.(C) No. 4431/2021) before the Headmaster for reappointing her to the post.

d) In the meantime, based on the request made by the Headmaster, a fresh notification was issued for the appointment of a Pre-Primary School teacher. In this context, it would be relevant to note that the Government had in fact, come up with G.O.No.37/2017 dated 7.5.2017

(produced as Ext.P15 in W.P.(C) No.4431/2021) fixing the modality of appointment of Pre-primary teachers. The above Government Order speaks about the constitution of an Interview Board, the manner of conducting the interview etc. The qualification for the post of Pre-Primary School Teacher is a pass in the Pre-Primary Teachers Training course or a pass in Bala Sevika course conducted by the Social Welfare Department.

e) Smt. Merlin also took part in the interview held for the post. f) Ext.P2 dated 19.01.2021 (produced in W.P.(C) No. 4431/2021) would reveal that though about 12 persons participated in the interview, only two persons produced the qualifying certificates. Ext.P3 order dated 20.01.2021 issued by the AEO would reveal that Smt. Merlin secured the 1st rank. Smt.Merlin says that on the strength of the order dated 20.01.2021, she joined the school.

g) On the strength of Smt. Siji’s complaint, a detailed report was called for by the AEO from the Headmaster. The Headmaster submitted a detailed report (produced as Ext.P5 in W.P.(C) No. 4431/2021) stating the reasons why Smt. Siji could not have been reappointed. Based on the above report, the AEO, after due application of mind, submitted a report (produced as Ext.P6 in W.P.(C) No. 4431/2021) stating that reappointment to Smt. Siji cannot be granted.

h) However, much later, order dated 12.2.2021 has been issued by

the DGE ordering the RDD, Wayanad to immediately grant reappointment to Smt. Siji.

i) In W.P.(C) No. 4431/2021, Smt. Merlin challenges Ext.P8 order issued by the Government ordering the reappointment of Smt. Siji.

j) W.P.(C) No. 8792/2021 is filed by Smt. Siji M.P to implement the

said order.

In the counter affidavit filed by the 1st respondent in W.P.(C) No. 4431/2021, it is stated that though Smt. Siji had resigned from the post for contesting the elections, her request for reappointment was considered as there is no bar in reappointing teachers who have resigned. It is stated that Smt. Merlin was appointed when Primary classes were not officially sanctioned due to COVID restrictions. It is further stated that it was after considering the extensive service of Smt. Siji as a teacher, she was granted an appointment originally. Later, the Government issued orders restricting the appointment of Pre-Primary teachers after the cut-off date of 07.12.2012. It is stated that it was only to accommodate the 6th respondent that the appointment was granted as a special case on 26.08.2017 despite the ban imposed by the Government. It is further stated that there was no urgency to appoint Smt. Merlin, as the primary classes had not commenced due to COVID-related

restrictions. Therefore, the appointment of Smt. Merlin was not done in a proper manner. It is also stated that pre-primary teachers are eligible only for honorarium, and therefore, they will not come under the purview of KSR and the KS & SSR, and therefore the appointment of Smt. Siji cannot be objected to. It is further stated that there is only one vacancy of Pre-primary school teacher in the school concerned.

In the counter affidavit filed by Smt. Siji, it is stated that she had started her career as an Instructor from 15.02.2000 to 31.03.2003. Later, based on various Government orders and considering the long service rendered by her, she was appointed as a Pre-Primary School Teacher with effect from 26.08.2017. It is further stated that there are two posts of Pre-Primary School teachers in GUPS, Pinangode, one sanctioned by the Government and the other post is one recommended by the PTA. Smt. Siji resigned from the post for contesting the election and when she lost the election, she sought to withdraw the resignation letter submitted by her. It is stated that the Government has issued an order dated 12.02.2021 sanctioning the reappointment of Smt. Siji. When she approached the office of the Headmaster, she was informed that appointment cannot be granted in view of the interim order issued by this Court in W.P.(C) No. 4431/2021.

I have considered the submissions of Sri.Sherry. J. Thomas, the learned counsel appearing for Smt.Merlin K.U, Sri.K.Kunhikrishnan, the

learned counsel appearing for Smt.Siji and also the learned Government Pleader.

The entire sequence of the events have been detailed above. Both Siji as well as Smt. Merlin are aspiring to the post of Pre-primary teacher in GUPS, Pinangode. There is no dispute to the fact that Smt. Siji was appointed to the post by an order dated 26.8.2017 issued by the Government. A perusal of the order would reveal that her appointment was in a vacancy that arose in the Kalpetta School, and it was as a special case, taking into account the service rendered by her in the alternative school. It is also not disputed that Smt. Siji submitted a resignation to contest the election. In the resultant vacancy, the appointment had to be made and qualified teachers were invited strictly in terms of the Government Order dated 7.5.2017. Ext.P15 produced in W.P.(C) No.4431/2021 details the qualifications of a Pre-Primary School teacher. Smt. Siji has no case that she is qualified to the post. Ext.P3 order dated 20.1.2021 issued by the AEO and Ext.P6 report would reveal that about 12 aspirants participated in the interview out of which only two were qualified and among them, Smt. Merlin secured the first rank. It would be apposite to mention at this juncture that after losing the election, Smt. Siji also applied for the post and participated in the interview and she was not selected. If that be the case, it would be too late in the day for Smt. Siji to contend that even after submitting resignation and contesting the

post, her resignation was not accepted by the authorities concerned. If her resignation had not been accepted, there was no reason why Smt. Siji applied for the post when fresh applications were called for and an interview was held.

In the counter filed by the official respondents, it is stated that the Government had restricted the appointment of Pre-primary teachers after the cut off date of 7.12.2012, and therefore, the appointment of Smt. Merlin is not in order. However, in the same breath, the 1st respondent justified the re-appointment granted to Smt. Siji. The 1st respondent cannot throw hot and cold at the same time. Ext.P15 issued by the AEO would reveal that specific criteria has been fixed by the educational authorities for appointment of Pre-Primary School teachers. Apparently, Smt. Siji is not qualified. The vacancy which had arisen due to her resignation had to be filled by a qualified personnel. It was to protect the interest of the students that an interview was held to appoint qualified personnel. The order unsettling the appointment of Smt. Merlin is arbitrary and cannot be sustained under law for the above reason.

In view of the discussion above, I am of the considered opinion that the petitioner in W.P.(C) No. 4431/2021 is entitled to succeed. W.P.(C) No. 4431/2021 will stand allowed. Ext.P8 order, ordering reappointment of Smt. Siji will stand quashed. The petitioner in W.P.(C) 4431/2021 shall be entitled

to continue on the strength of Ext.P3 approval and she shall also be entitled to all consequential benefits. W.P.(C) No.8792 of 2021 will stand dismissed.
