The petitioner and 4 others approached the Wakf

¶53

Board with a petition to conduct an enquiry into gross misappropriation of the funds and properties of Karinganad juma masjid Sangham. An interlocutory application was also filed for appointing an interim muthawalli or an Executive Officer pending disposal of the Original Petition.

Due to the delay in considering the interlocutory

application the petitioner approached this court by filing

W.P.(C) No.19010 of 2020 and this court by Ext.P3 judgment dated 15.9.2020 disposed of as follows:

“2. The petition itself was filed in the month of July. The Wakf Board has all Kerala jurisdiction and has to supervise the affairs of the Wakfs all over Kerala. We do not think that there is any requirement for a mandamus at this stage. Still we direct that the Wakf Board may consider the petition at the earliest especially considering the other petitions pending before it.

Writ petition is disposed of without any observation on merits or even the maintainability of the petitions before the Board, Every such aspect would be open for consideration by the Board.”

It is contended that after the order in Writ Petition,

Ext.P1 was numbered as O.P. No.48 of 2020 and summons

was issued thereafter, the first respondent passed an order

appointing an Advocate Commissioner for inspecting the property with the assistance of a local surveyor. Though Ext.P6 order was passed by the Board on 5.7.2022, directing the Divisional Officer, Thrissur to get steps for getting the property surveyed by the Taluk Surveyor, it is not being done and Ext.P2 is not disposed of till date. Hence prayed for disposal of Ext.P2 application within a time limit.

We have heard the counsel for the Board Sri. Jamsheed Hafiz and he submitted that only after completing the survey of the property and inspection, the appointment of interim muthawalli can be taken into consideration and the Board requires at least four months for the same. Accordingly, the first respondent Wakf Board is directed to take up Ext.P2 application and dispose of the

same after hearing both parties, as early as possible and at any rate, within a period of four months from the date of

receipt of a copy of this judgment.
