JUDGMENT

Petitioners are teachers working at Memunda Higher

¶43

Secondary School of which the 5^th respondent is the Manager. The grievance raised by the petitioners in this writ petition is that approval of appointment during certain spells of service of the petitioners was rejected by the 4^th respondent as per Exts.P2, P5, P8, P12, P15, P18, P21, P25, P28, P31, P34, P40 and P44 orders. The period for which approval of appointment is sought by the petitioners is detailed in

Ground 'C' of the Writ Petition which is extracted below:

“C) The appointment of the 1^st petitioner for the period from 5.6.2006 to 31.5.2007 is to be approved, the appointment of the 2^nd petitioner from 4.6.2007 is to be approved, the appointment of the 3^rd petitioner from 4.6.2007 to 1.6.2008 is to be approved, the appointment of the 4^th petitioner from 4.6.2007 to 1.6.2008 is to be approved, the appointment of the 5^th petitioner from 4.6.2007 to 1.6.2008 is to be approved, the appointment of the 6^th petitioner from 1.6.2007 to 31.5.2010 is to be approved, the appointment of the 7^th petitioner from 2.6.2008 to 31.5.2009 is to be approved, the appointment of the 8^th petitioner from 2.6.2008 to 31.5.2010 is to be approved, the appointment of the 9^th petitioner from 14.7.2006 to 31.5.2007 is to be approved, the appointment of the 10^th petitioner from 9.8.2007 to 11.7.2010 is to be approved, the appointment of the 11^th petitioner from 2.6.2008 to 31.5.2010 is to be approved, the appointment of the 12^th petitioner from 3.8.2009 to 31.5.2010 is to be approved, the appointment of the 13^th petitioner from 1.6.2010 to 31.5.2011 is to be approved, the appointment of the 14^th petitioner from 1.6.2009 to 31.5.2010 is to be approved, the appointment of 15^th petitioner from 12.7.2010 to 31.8.2010 is to be approved and the appointment of the 16^th petitioner from 02/08/2010 till 13/07/2014 is to be approved.”

It is the contention of the petitioners that the said period mentioned

above was not approved only due to the ban on appointment imposed

by the Government in aided school as per GO(P) No.317/2005 dated

17.08.2005. It is further contended that even though the said ban imposed by the Government order dated 17.08.2005 was lifted as per Exhibit P46 Government order dated 12.01.2010, the appointment of the petitioners was not approved on the ground that the Manager of the school has not executed a bond as envisaged in GO(P) No. 10/10/General Education dated 12.01.2010, undertaking that sufficient number of protected teachers will be appointed in the future arising vacancies in the school equivalent to the appointment already made by them during the period of the ban. It is the case of the petitioners that this issue has been considered by this Court in Exts.P47 to P49 judgments holding that non execution of bond by the Manager cannot be a reason for rejecting the approval of the appointment of the teachers. It is the case of the petitioners that Exhibit P48 judgment is in respect of teachers of the very same school where the petitioners are working, whose appointments were also rejected during the ban period and that this Court as per the said judgment has directed the Educational Authorities to approve the appointment of the petitioners therein and grant them all consequential benefits. In the light of the above, it is contended by the petitioners that they are similarly situated and are entitled for approval of their appointment as directed by this court in similar cases evidenced by Exhibit P47 to 49 judgments.

A counter affidavit dated 05.08.2001 has been filed on

behalf of the 4^th respondent District Educational Officer. Paragraphs 2

and 3 thereof read as follows:

"2. A manager who refuses to execute a bond in terms of G.O. (P).No.10/10/G.Edn dated, 12.01.2010, he is deemed to have executed a bond in terms of the above G.O which results in the fact that all the conditions stipulated in the Government Order are also deemed to have undertaken to appoint sufficient number of protected teachers in the future arising vacancies in the School equivalent to the appointment already made by him during the period of ban. The Government vide letter No.A2/70/18 dated, 18.07.2018 has specifically directed that the appointment of Petitioners in the Writ Petition can be approved stipulating the condition that only protected teachers can be appointed in all vacancies arising subsequent/resultant to the approval of the Petitioners, as the Manager is deemed to have executed the bond.

3. The Judgment issued by this Honourable Court in Writ Petition is complied with as far as the petitioners are concerned. As the Manager is deemed to have executed the bond in accordance with the said Government Order are also deemed to be applicable. Hence, the Manager is deemed to have executed the bond is liable to appoint sufficient number of protected teachers in the future arising vacancies in the School equivalent to the appointments made by him and approved to comply with the Judgments in the above Writ Petition. As any action towards crediting the monetary benefits consequential to the compliance of the Judgment is initiated from the School, the Headmaster of the School is to be impleaded to avoid further procedural delay in this regard."

affidavit is that even if a Manager refuses to execute a bond in terms of

Ext.P46 Government Order, he will be deemed to have executed a bond in terms of the above Government Order and further that the Government as per letter No.A2/70/18 dated 18.07.2018 has specifically directed that the appointment of the petitioners in the writ petition can be approved stipulating the condition that only protected teachers can be appointed in all vacancies arising subsequent/resultant

to the approval of the petitioners as the Manager is deemed to have

executed the bond. The contention raised by the petitioners is covered by the earlier judgments of this Court evidenced by Exts.P47 to P49, which directed the District Educational Officer concerned to issue revised orders approving the appointment of the petitioners therein and to re-fix their pay based on such revised approval and grant them all consequential benefits. As is evidenced from the counter affidavit filed by the 4^th respondent, the Government has also directed to approve the appointment of the petitioners.

In the light of the above, I find no justifiable reason in rejecting the approval of the appointment of the petitioners. Therefore, I quash Exts. P2, P5, P8, P12, P15, P18, P21, P25, P28, P31, P34, P40 and P44 orders issued by the 4th respondent with a consequential direction to approve the appointment of the petitioners for the period enumerated in Ground 'C' of the writ petition, which is extracted in paragraph 1 of this judgment, and re-fix their pay, based on such revised approval and grant them all consequential benefits within a period of 3 months from the date of receipt of a copy of this judgment.

Accordingly, the Writ Petition is disposed of as above.
