JUDGMENT

The relief claimed in the writ petition reads

thus:

“Issue a writ of mandamus or any other appropriate writ or order commanding the 2^nd respondent to conduct fitness test relating to the vehicles mentioned in Exhibit.P1 taking note

of the issuance of Exhibit.P3 exemption Certificate, Exhibit.P4 Tax receipt and Exhibit.P5 receipt evidencing acceptance fees for conducting fitness test by the 1^st respondent without any further delay.”

The learned Government Pleader, on

instructions, submits that the application for fitness certificate is to be considered by the 2^nd respondent and that the required fee has not been remitted on the application. As and when the requisite fee is paid, the application will be considered and appropriate orders passed, is the submission.

Accordingly, without expressing anything on the merits, the writ petition is disposed of directing that, in the event of the petitioner paying the requisite fee for consideration of the application, the 2^nd respondent shall consider the application in accordance with law and pass orders thereon within a period of one month therefrom.
