JUDGMENT

Since common issues arise for consideration in

both the writ petitions, they are disposed of by this common judgment.

W.P.(C) No.19800 of 2022 is filed for a direction to respondents 1 and 2 therein to take action against certain constructions carried out by the 3^rd respondent (petitioner in W.P. (C) No.20110 of 2022), without building permit from the 1^st respondent Panchayat. On 17.06.2022, this Court has passed an interim order that if the petitioner brings to notice any illegal construction before respondents 1 and 2, they shall ensure that no illegal construction is carried out without building permit.

W.P.(C) No.20110 of 2022 is filed by the 3^rd respondent in W.P.(C) No.19800 of 2022 challenging

Exts.P5 and P6 proceedings initiated by the 2^nd respondent against the construction being carried out by him and for a direction to the 2^nd respondent to grant permission to the petitioner for reconstruction of the building and to consider the application for building permit receipt of which is evidenced by Exts.P7 and P8, expeditiously.

When these writ petitions came up for further consideration today, Sri.Sunil Cyriac, the learned Standing Counsel for the Panchayat submits that, the petitioner in W.P.(C) No.19800 of 2022 has filed an objection to the application for building permit submitted by the 3^rd respondent therein and that the said petitioner was heard on 01.07.2022 on his complaint against the unauthorised construction alleged to be carried out by the 3^rd respondent. The learned Standing Counsel further submits that the 2^nd respondent will hear both the writ petitioners and will

pass appropriate orders on the application for building permit. Recording the said submission, these writ petitions are disposed of with a direction to the 2^nd respondent to consider the application of the petitioner in W.P(C) No.20110 of 2022 for building permit and pass appropriate orders within a period of one month from the date of receipt of a copy of this judgment, after affording an opportunity of being heard to the petitioners. Till such time, the interim order dated 17.06.2022 passed by this Court in W.P. (C) No.19800 of 2022 will continue.
