JUDGMENT

The petitioner contends that as he is the seniormost person eligible to be appointed to the post of Headmaster, he has placed a request before the 3rd respondent to grant provisional promotion, which is pending as Ext.P6. Later, he has preferred Exts.P7 and P8 representations as well. According to the petitioner, though he has appeared for the Departmental Tests and in all likelihood, the results have not been published to date. It is in the above backdrop that the petitioner is before this Court seeking directions to the 3rd respondent to consider Exts.P6 and P7 representations and to take a decision.

I have heard Sri.Nidheesh S., the learned counsel appearing for the petitioner and Sri.Joby Joseph, the learned Senior Government Pleader.

After having carefully evaluated the contentions raised in this writ petition, the submissions made across the Bar, and the facts and circumstances, I am of the view that this writ petition can be disposed of at the admission stage itself by issuing the following directions:

a) There will be a direction to the 3rd respondent to take up, consider and pass appropriate orders on Exts.P6 and P7, after affording an opportunity of

being heard, either physically or virtually, to the petitioner

herein or his authorized representative.

b)Orders, as directed above, shall be passed expeditiously, in any event, within one month from the date

c) It would be open to the petitioner to produce a

copy of the writ petition along with the judgment before the concerned respondent for further action.
