than that to prove his jail sufferings. Therefore, I have no manner of doubt in my mind that any delay in paying SSS pension and family pension to the petitioner in respect of the petitioner's husband's jail sufferings on the basis of that document would be nothing but lack of patriotism and cruelty. The petitioner's husband and the petitioner have more than amply proved the jail sufferings of the petitioner's husband required for becoming eligible for pension under the SSS Pension Scheme. Therefore, the petitioner has become entitled to arrears of SSS pension due to the petitioner's husband and also family pension as the widow of the freedom fighter. Accordingly, this writ petition allowed. The impugned orders are quashed. The 1st respondent is directed to pay to the petitioner arrears of SSS pension due to the petitioner's husband and arrears of family pension due to the petitioner on the death of the petitioner's husband, as expeditiously as possible, at any rate, within one month from the date of receipt of a certified copy of this judgment. The petitioner is entitled to interest at the rate of 6% on the said amount. With respect to who shall bear the interest amount, it would be open for respondents 1 and 3 to decide between themselves. Needless to say, at the first instance, the interest shall be paid by the 1st respondent to the petitioner and the adjustment shall be made by respondents 1 and 3 between themselves. The SSS pension shall be paid from the date of the application, as stated in Ext.P4, viz., 20.4.1998, and family pension with effect from the date of death of the petitioner's husband, viz., 17.12.2006. The petitioner shall be paid future family pension every month without default. Because of the uncharitable and impatriotic attitude of the respondents in not granting SSS Pension to the petitioner's husband while he was alive despite his producing certified extract from an original record kept by the State Government, I was inclined to award costs also. However, taking a lenient view, I refrain from doing so.”
