The petitioner filed O.P.No.643 of 2022 before the Family Court, Muvattupuzha against the respondent herein-wife, under Sections 13(1)(ia) and 13(1)(ib) of the Hindu Marriage Act, 1955, seeking a decree of divorce dissolving the marriage solemnized on 04.02.2010. During the pendency of that original petition, the parties were referred for mediation. They settled the disputes in mediation. As part of that settlement, they filed O.P.No.858 of 2022, a joint petition to dissolve the marriage by mutual consent, under Section 13B of the Hindu Marriage Act, 1955 (Ext.P1), along with I.A.No.2 of 2022 (Ext.P11 application), seeking an order to waive the statutory waiting period. In the affidavit filed in support of that application, they placed reliance on the judgment of the Apex Court in Amardeep Singh v. Harveen Kaur [(2017) 8 SCC 746] . They have also filed I.A.No.1 of 2022, seeking an order to advance the hearing of O.P.No.858 of 2022 from 27.02.2023 to a near date. That application ended in dismissal by Ext.P13 order dated 15.09.2022 of the Family Court, which reads thus;
