JUDGMENT
When the matter came up for hearing today, the
learned counsel for the appellant fairly submitted that
the appeal will not stand in view of the legal position
settled by the Division Bench of this court in National
Insurance Co.Ltd. v. Sindhu (2011(3) KLT 590).
Accordingly, the appeal is dismissed in view of the
legal position settled as above.
