Petitioner is the 1st accused in crime 695/2009 of Kottayam East police station, which was registered on 27.10.2009 alleging offence under Sections 294(b) and 506(i) of the Indian Penal Code. The precise allegation against the accused persons in the crime was that, that day at 1.30 p.m. the defacto complainant and his brother had gone to Kottayam District Court Complex to adduce evidence before the Judicial First Class Magistrate's Court, Kottayam in CC 9/2009. He was the defacto complainant in that case also. The case stood passed over for taking up in the afternoon. Then he went to the co-operative society canteen in the Collectorate compound for taking lunch along with his brother and at that time the accused persons in C.C. 9/2009 i.e. accused 1 and 2 in the crime, intimidated him stating that if he does not withdraw from the prosecution in C.C. 9/2009, his legs would be chopped off. Immediately he gave a complaint in writing to the Judicial First Class Magistrate-I, Kottayam which was forwarded to Kottayam East police station for registering the crime and thus the crime was registered and after investigation the charge sheet was laid before the same Court alleging offence under Sections 294(b) and 506(i) of the IPC.
