Petitioner is the first accused in crime 124/2011 of Kadinamkulam police station, which is now pending before the Assistant Sessions Court, Attingal as S.C. 1392/2012 where she, along with others, faces allegations under Sections 143, 147, 148, 452, 324, 326 and 308 read with 149 of the Indian Penal Code. It is submitted that her elder son is permanently settled in United Kingdom; a son is born to him on 26.07.2021 and in order to see and take care of the child, she wants to leave the country facilitating which she moved an application before the trial court for granting exemption under Section 6(2)(f) of the Passports Act and seeking leave of the Court for two years to remain abroad. Even though the Court had considered the application, she was granted permission only for three months. According to the learned counsel for the petitioner, in order to process an application for visa alone, three months' time is necessary. So the period granted by the Court is too short. The learned counsel also undertakes that the petitioner will appear before the trial Court as and when necessary; her younger son is studying at Thiruvananthapuram so that she cannot remain abroad for long and that she is prepared to abide by any condition imposed by this Court.
