The learned counsel appearing for the petitioner seeks permission to withdraw the Crl.M.C with liberty to the petitioner to file an application under Section 239 Cr.P.C seeking discharge before the trial Court.

Permission granted. The learned counsel for the petitioner prayed for dispensation of the personal appearance of the petitioner before the trial Court. The petitioner is at liberty to file an application for exemption from personal appearance before the trial Court. If such an application is filed, the Court below shall dispose of it in accordance with law.

The Crl.M.C is dismissed as withdrawn with liberty to the petitioner to seek plea of discharge before the trial Court.
