This is an application for regular bail.

¶21

Petitioners are accused Nos.1 to 3 in Crime

¶22

No.1298/2021 of Anchal police station, Kollam district, alleging commission of offences under Sections 406 and 420 r/w. Section 34 of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that no charge sheet has been filed in the matter and as on date, the petitioners are entitled to statutory bail. This submission is not disputed by the learned Public prosecutor.

Having regard to the fact that the petitioners are entitled to statutory bail as on date, without going into any other aspect, I am of the view that the petitioners can be released on bail subject to strict conditions. Accordingly, this application for bail is allowed and it is directed that the petitioners shall be released on bail subject to the following conditions:-

(i) Petitioners shall execute separate bonds for sums of Rs.50,000/- (Rupees fifty thousand only) each with two solvent sureties each for the like-sum to the satisfaction of the jurisdictional court;

(ii) Petitioners shall appear before the investigating officer in Crime No.1298/2021 of Anchal Police station on every Saturday at 11 am until further orders;

(iii) The petitioners shall not attempt to interfere with the investigation or to influence or intimidate the de facto complainant or any witness in Crime No.1298/2021 of Anchal police station;

¶29

(iv) The petitioners shall surrender their passports before the jurisdictional court. If the petitioners do not have a passport, they shall execute an affidavit to that effect and file the same before the said court within seven days of release on bail;

(v) The petitioners shall not involve in any other crime while on bail.

If any of the aforesaid conditions are violated, the investigating officer in Crime No.1298/2021 of Anchal police station may file an application before the jurisdictional court, for cancellation of bail.
