complainant passed away on 01.12.2019. It is submitted that at the request of the husband of the de facto complainant the petitioners had expended amounts for the purpose of reconstructing the house of the de facto complainant and her husband which had been destroyed in the floods of 2018. It is also submitted that the husband of the de facto complainant agreed to convey certain property to the petitioners and following the death of the husband of the de facto complainant, the de facto complainant herself had executed a settlement deed in favour of the petitioners conveying certain property in their names. It is submitted that following the death of the husband of the de facto complainant, she had gone to live with her relatives for some time and thereafter complaints have been raised against the petitioners and proceedings have been initiated for re-conveyance of the property conveyed to the petitioners before the Revenue Divisional Officer, Fort Kochi under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. It is submitted that the complaints have been raised regarding changing of name of nominee in the bank account etc. , at the instance of the relatives of the de facto complainant and that the petitioners are absolutely innocent in the matter. Finally it is submitted that the petitioners are themselves senior citizens aged 71 and 65 respectively and that their custodial interrogation is not necessary for the purpose of the proper investigation of Crime No. 1165/2021 as all the allegations are those which can be proved by documents.
