J U D G M E N T

The petitioner, who aspires recruitment in Army, is aggrieved by the denial of Police Clearance Certificate by the 2^nd respondent. At the same time, it is submitted that he is an accused in Crime No.1384 of 2020 of Naruvamoodu Police Station for offences under Section 447, 323 and 294(b) of IPC.

Heard the learned Government Pleader, who submitted that as long as

a crime is pending against the petitioner, no clearance certificate can be issued to him by the Police.

However, as the petitioner has submitted Ext.P3 representation, there shall be a direction to the 2^nd respondent to issue a certificate to him, wherein reference can be made about the crime pending against him. This shall be done within a period of three days.

The Writ Petition is disposed of accordingly.
