The petitioner has approached this Court aggrieved by Ext.P3 notice that has been issued to him, whereby, the Secretary of the respondent Municipality has taken a stand that the land belonging to him is classified as 'Nilam' in the BTR and accordingly, the constructions contemplated in this land cannot be permitted. In as much as Ext.P3 is only a notice issued to the petitioner, the petitioner can file his objections to the same and get the matter adjudicated at first instance by the Secretary of the respondent Municipality. To enable the petitioner to do this, I direct the petitioner to file a reply to Ext.P3 notice within 10 days from today, and on receipt of the said reply, the 2nd respondent shall consider the same and pass orders in the matter, after hearing the petitioner. If a decision adverse to the petitioner is taken by the 2nd respondent, the respondent shall clearly indicate in the order the reasons for the same. The said order of the 2nd respondent shall be passed within a period of one month from the date of receipt of the reply from the petitioner. The petitioner shall produce a copy of the writ petition together with a copy of this judgment, before the respondent, for further action.
