1.The substantial prayer in these writ petitions is the challenge against the CGPA marking system allegedly inserted in the end semester examinations in the first respondent University. The petitioners seek further directions and declarations that they shall be declared as having passed the semester examination, in view of the fact that they have secured the pass marks in the written examinations. Ext.P1 order issued by the University on 03.08.2020 with regard to the conduct and the passing of the examinations are also under challenge.

2.The petitioners in these writ petitions are students of affiliated Engineering colleges under the A.P.J Abdul Kalam Technological University. They contend that they have secured pass marks in the end semester examinations conducted by the first respondent. However, due to the prescription in Ext.P1 order that they should secure the CGPA prescribed in addition to

passing the end semester examinations, they have been declared as having failed in the examinations. It is contended by the learned counsel for the petitioners that since the petitioners have secured the pass marks in the examinations conducted by the respective colleges, the prescription by the University that they should secure the CGPA for a successful completion of the semester is completely untenable and is liable to be set aside.

3.It is further submitted that pursuant to an interim order issued by this Court on 04.12.2020, the issue was considered by the student grievance cell and a report was also placed on record. It is the case of the learned counsel for the petitioner that the calculation of the CGPA is a completely opaque procedure, which is not understood by the colleges or the students and that as such is open to rampant misuse by the officials of the University.It is submitted that the petitioners, who have passed the examinations conducted with regard to the semesters in question, are liable to be declared as having passed in the examinations and the reliance on the CGPA is completely untenable.

4.A statement was initially placed on file on 20.11.2020, pursuant to the initial interim order of this Court dated 09.11.2020. Ext.R1(a), which is the scsores of the petitioners in the examinations conducted by the respective colleges in the 8^th semester, was produced as Ext.R1(a).

It is submitted that the University permitted the petitioners to appear for the end semester examinations even though their CGPA was low. It was stated that the semester grade depends on the average of the grades of all subjects in a particular semester and depending on the results of the students in the regular examinations, supplementary examinations and reevaluation, if any, there was a chance of change in the CGPA.

It was further submitted that in the case of lateral entry students, in order to ensure that they are not put to disadvantage, their average CGPA for five semesters alone is counted, instead of the seven semesters as in the case of other students. The details of the CGPA and its calculations were also produced along with the statement.

7.Thereafter, another statement was placed on record on 24.11.2020, stating the Ext.P1 decision had been taken by the University on the basis of the AICTE norms and after consideration of the relevant factors by the academic counsel of the University.

8.An additional statement was thereafter placed on record on 30.11.2020. Ext.R1(b), which is a table of the CGPA secured by the petitioners was

produced. Thereafter, Ext.R1(a), which is a report of the hearing convened by the Grievance Redressal Cell of the 1^st respondent University on 08.12.2020 on the basis of the directions issued by this Court was also placed on record.

A detailed counter affidavit was filed on 11.02.2021. It is submitted that on the basis of the AICTE directions dated 01.05.2020, the guidelines issued by the UGC on 29.04.2020 for conduct of the lower semester examinations for

the B.Tech course had been followed by the University by Ext.R1(c) proceedings dated 28.07.2020. It is stated that these guidelines are with regard to the lower semesters other than the final semesters and have no application for final semester B.Tech. It is further stated in the counter affidavit as follows:-

“6. It is submitted that the UGC directed that for students of lower semesters, grades can be awarded based on their performance in previous semesters. Hence, for lower semesters, examinations are not conducted and their grades are assessed only based on their past performance (CGPA). Hence, the grade of a student in the current semester depends on his CGPA of the previous semester, Only those who have the desired CGPA will be eligible for pass grades and if a student does not have the required CGPA to get a pass grade in the current Semester he/she will have to wait till his past performance entitles him to get the desired CGPA. Since no examinations are conducted, the only option is to keep the student in the “withheld category” till his/her previous semester performance enables him to get the desired CGPA. However, in the final semester, the student has to be assessed through examinations alone and if the student fails in an examination, he/she is

expected to write the examination in the next supplementary chance and clear it as has been specifically mentioned in the U.O. dated 03/08/2020. True copy of the U.O.No.1191/2020/KTYU dated 03.08.2020 is produced herewith and marked as ExhibitR1(d).

It is submitted that the norms and regulations prescribed for both examinations, i.e., the 4^th semester and the end semester exams are different and derived as per the directions tipulated by the UGC. The UGC made the conduct of the final year examinations mandatory and as per the UGC regulations, final year students’ performance can be assessed only through examinations and accordingly, the first set of the final year examinations were conducted as per the detailed Guidelines prescribed in the U.O. No. 1101/2020/KTU dated 03/08/2020 (Ext. P1) from August 10" 2020 to August 20" 2020. The results of the first set of the final year examinations were declared on 19/09/2020 and certificates were also distributed.

It is submitted that Clause 19 of the said U.O. dated 03/08/2020 stated that,” if a student is not satisfied with the grade obtained in any subject as discussed above, he/she has the option to improve the grade of the particular grade by appearing the end semester exam in the next available chance which will be treated as his/her first chance. Provisions for improvement will not be available in any other chance thereafter.” Accordingly, the second set of examinations for final year students were held on 10/11/2020 and the results were declared on 06/02/2021. Students who have opted for improvement of their grades were awarded new grades based on their performance in the second set of examinations and such improvements were treated as their first chance. It is submitted that none of the petitioners availed of this opportunity to improve their grades. True copy of the status report of the petitioners along with a few others is produced herewith and marked as Exhibit-R1(e).

It is submitted that a final year student cannot claim the benefit of any regulation fixed for lower semester examinations as the UGC has exempted lower semester students from examinations and simultaneously made examinations compulsory for the final semester students. Therefore, regulations applied to lower

semester students are on a different level and in a different context than final year students and a final year student cannot complete his degree without appearing for his final year examinations and passing in all subjects.”

10.It is submitted by the learned counsel appearing for the 1^st respondentUniversity that the petitioners, who did not have the required Combined Grade Points Average in the previous semesters could not be declared as having passed, even if, they had been permitted to attempt the final semester examinations since they would be eligible to be enrolled in the final semester, only if they have the required CGPA in the previous semesters. It is stated that only for the reason that the petitioners have secured the pass mark in the final semester examinations will not take away the requirement of their securing the necessary CGPA in the previous semesters. It is therefore contended that if the petitioners have to improve the CGPA in the previous semesters and secure the required CGPA for a pass before they can be declared as having passed the B.Tech course.

I have heard the learned counsel on all sides and have considered the contentions advanced.

It is not in dispute that the method of assessment of the Cumulative Grade Point Average as a method of assessment has been adopted by the

University on the basis of the guidelines issued by the UGC as recommended by the AICTE. By the decision of the Academic Council held on 29.04.2017 the affiliated colleges and all students had been informed that the Grade Point Average system of assessment is implemented for each semester of the B.Tech program. It is submitted that as per Ext.P1, taking note of the fact that end semester examinations could not be held by the University during the pandemic. Revised guidelines had to be issued by the University for meeting the exigencies of the situation. It is stated that since semester examinations, supplementary examinations and revaluations were conducted and results declared between 02.08.2020 and 17.09.2020 and there was a chance of improving CGPA by the students, all students were permitted to write the final examinations without a bar of CGPA only to benefit such students. It is stated that as per Clause 14 of Ext.P1, students had been given a consideration in their institution wise examination by multiplying the actual marks by 1.42857. They were also given consideration by lowering the minimum CGPA as well. It is stated that only because the petitioners had been permitted to write their final end semester examinations that does not mean that they do not have to secure the CGPA as provided in Ext.P1 for being declared as 'passed'. It is submitted that Ext.P1 is beneficial to the students and those of the

petitioners, who did not secure the minimum required CGPA even going by the relaxed conditions in Ext.P1, cannot contend that they are eligible for being declared as passed only because they secured the pass marks in the examination without securing the required CGPA.

In the above factual situation, I am of the opinion that the prayers sought for in the writ petition cannot be granted. The writ petition fails and the same is, accordingly, dismissed.
