This appeal has been filed challenging a decree granted in favour of the respondent to recover 65 sovereigns of gold ornaments or its equivalent value of Rs.10,01,000/- from the appellant.

Pending matter, the parties sorted out their differences and the appellant agreed to pay a sum of Rs.5,00,000/- for full and final satisfaction of the claims made by the respondent.

The parties appeared through online. The respective counsel identified them. The appellant submits that he has paid a sum of Rs.4,00,000/-(Rupees Four Lakhs only) out of Rs.5,00,000/(Rupees Five Lakhs only). The respondent also admits receipt of the same. The appellant submits that he will pay the balance amount of Rs.1,00,000/- (Rupees One Lakhs only) within six months from today. The respondent agreed for the same.

In the light of the above, we dispose of this appeal modifying the impugned order as follows:

(i) The appellant shall pay a sum of Rs.5,00,000/- (Rupees

Five Lakhs Only) in full and final satisfaction of the claim of the respondent.

(ii) The respondent admits receipt of a sum of Rs.4,00,000/(Rupees Four Lakhs only) out of the above Rs.5,00,000/-(Rupees Five Lakhs only).

(iii) The balance amount of Rs.1,00,000/- (Rupees One Lakhs only) will be paid by the appellant within six months from today.

(iv) In the event of failure to pay the balance amount within six months, it will carry interest @ 6% from the date of default till realization.

The impugned order will stand superseded by this judgment.
