the bye law of the 1st defendant Trust by defendants 2 to 15 while contesting the election for appointment of office bearers of the 1st defendant Trust. According to him, for becoming a managing committee member of the Trust, the person should be a permanent resident within the territories of Naduvathu Cherry, Thekkumbhagom , Dalavapuram, Kochuthuruth, Velithurth and Puthuruthu of Chavara Thekkumbhagom Village and the territorial limits of the above places were not altered or changed as per the provisions of the bye law. According to him, the observation made by the Sub Judge in the impugned order that there were only 4 wards in Chavara South and with passage of time, Naduvathuchery was divided into several wards is devoid of any basis. According to him, as per Section 33 of the bye law for getting a provision amended, added or altered a resolution should have been moved in the General Body meeting and a minimum of 75% of the members of the society, attended the meeting. According to him, the violations though have been pleaded in the application seeking injunction, the court below failed to advert to those in the right perspective and observed in the impugned order that the defendants are bound to discharge their duties and that if any order restraining them from
