APPLICATION FOR REGULAR BAIL

The applicant is the sole accused in Crime No.1275 of 2020 of Kulathupuzha Police Station, Kollam, for having allegedly committed offences punishable under Sections 294(b), 447, 506(ii) and 326 A of the IPC. The prosecution case, in brief, is this:

On 26.11.2020, at about 4.30 PM, the applicant trespassed into the courtyard of the house of the defacto complainant, who is his father-in-law and hurled abuses at him and thereafter intimidated him and poured acid from a jerry can over his body, caused extensive burns and grievous hurt to him. The applicant was arrested on 28.11.2020 and has been in custody since then. Investigation is almost over. The applicant has been interrogated. And, therefore, he seeks regular bail.

Heard the learned counsel appearing for the applicant and the learned Public Prosecutor. The applicant admittedly has no criminal antecedents. The investigation is over. And, I

therefore, do not find any reason to further detain him.

In the result, the application is allowed and the applicant is directed to be released on bail on the execution of a bond for Rs.50,000/-(Rupees Fifty thousand only), with two solvent sureties, each for the like amount to the satisfaction of the jurisdictional court and on following further conditions:

(i) He shall appear before the Investigating Officer on all Saturdays between 9.00 AM and 12.00 PM for a period of two months.

(ii) He shall not intimidate or influence witnesses and

tamper with evidence.

¶30

(iii) He shall not get involved in similar offences during the currency of the bail period.

¶31

In case of breach of any of the bail conditions, the prosecution shall be at liberty to apply for cancellation of the bail before the jurisdictional court.

The bail application is allowed.
