Application for regular bail under Section 439 Cr.P.C.

The applicant is the 10^th accused in Crime No.612/2020 of Changaramkulam Police Station,

Palakkad, for having allegedly committed offences punishable under Sections 363, 364A, 342, 395 and 120B r/w Section 34 of the IPC.

The prosecution case, in brief, is that the

applicant and the other co-accused hatched a conspiracy to kidnap one Shijoy, S/O Tharukutty

¶22

for random and on 29.10.2020 at about 8 p.m, the

¶23

applicant along with the other co-accused kidnapped the aforesaid person from Edappal and

¶24

housed him in a lodge at Annamkkampad and

¶25

thereafter robbed him of gold chain, Rolex watch,

¶26

a diamond ring, a gold bangle, a pair of

¶27

spectacles and a Toyota Fortuner Car worth

Rs.36,50,000/- and thereafter demanded a sum of Rs. 3 crore and 60 lakh from him as a ransom. When the de facto complainant was found missing, his wife had initially filed a complaint before the Chalissery Police Station and thereafter the applicant himself appeared before the

Changaramkulam Police Station and narrated the incident and in consequence of which the present crime was registered. The applicant was arrested on 05.12.2020 and has been in custody since then. Some of the co-accused has already been released on bail. They are similarly placed and therefore the applicant seeks regular bail.

Heard the learned counsel for the applicant and the learned Public Prosecutor.

The learned Public Prosecutor submits that

the applicant has no criminal antecedents. He has been subjected to custodial interrogation and therefore further incarceration of the applicant

may not be necessary.

allowed and the applicant is directed to be

released on bail on execution of bond for Rs.50,000/- (Rupees Fifty thousand only) with two solvent sureties for the like amount each to the

satisfaction of the jurisdictional court and on

the following conditions;

officer on all Saturdays between 9 a.m and 12 noon for a period of three months or till filing of the final report whichever is

earlier.

intimidate the witnesses.

3.He shall not get involved in similar offences during the currency of the bail.
