Heard the learned counsel for the petitioners

and also the learned Public Prosecutor. The offences

¶22

alleged are under Sections 406 and 420 of Indian Penal Code, Section 45S of Reserve Bank of India Act and Section 17 of the Kerala Money Lenders Act. According to the learned counsel, the first petitioner is a registered money lender and the second petitioner is his Manager and that, pursuant to the interim order dated 11.05.2021, they have presented themselves before the investigating officer and produced all the necessary records. They have

also given possible answers to the queries put by the investigating officer and no further interrogation is necessary.

Learned Public Prosecutor also says that, in the nature of the allegations, further interrogation of the petitioners is not necessary. Therefore, the petition can be allowed. In the event of arrest, the petitioners shall be released on bail on the

following conditions:-

i) The petitioners shall appear before the Investigating Officer within seven days from today and will make themselves available for interrogation if any;

ii) In the event of arrest, they shall be released on bail on executing a bond for Rs. 50,000/-(Rupees Fifty Thousand Only) with two solvent sureties each for the like sum to the satisfaction of the Investigating Officer;

iii) They shall co-operate with the investigation, shall not try to contact or influence the witnesses or tamper with the evidence;

iv) They shall not involve in any crime during the period on bail;

¶32

v) They shall appear before the Investigating Officer/Court as and when required;

vi) They shall strictly follow the various guidelines issued by the State and Central Governments with respect to keeping of social distancing in the wake of Covid 19 pandemic;

vii) If any of the above conditions are violated by the petitioners, the jurisdictional court shall be at liberty to cancel the bail, in accordance with law.
