This Bail Application filed under Section 438 of Criminal Procedure Code was heard through Video Conference.

The applicants are the accused in Crime No.0006 of 2021 of Ambalathara Police Station, Kasaragod District, for having allegedly committed offences punishable under Sections 341, 324 and 308 read with Section 34 of the IPC.

The prosecution case, in brief, is that on 01.01.2021 at about 1.00 hour at a place called Cheralam, in Thayannur Village, the applicants had in furtherance of common intention wrongfully restrained the de facto complainant and allegedly attacked him with a dangerous weapon like knife.

The applicants state that the allegations are not true and that they have been falsely implicated and they do

not have any criminal antecedents. They are willing to cooperate with the investigation and hence seek pre-arrest bail.

Heard the learned counsel appearing for the applicants and the learned Public Prosecutor.

The learned Public Prosecutor admits that the applicants have no criminal antecedents. The injury sustained to the injured is not serious or grievous. But, the knife will have to be recovered, for which the applicants are willing to co-operate with the investigation.

Hence, the applicants are directed to surrender before the Investigating Officer within two weeks. In the event of their being arrested, after interrogation and recovery, if any, they shall be released on bail on the execution of bonds for Rs.50,000/-(Rupees Fifty thousand only), each with two solvent sureties, each for the like amount to the satisfaction of the Investigating officer and on following further conditions:

(i) They shall appear before the Investigating Officer as and when called for.

(ii) They shall not intimidate or influence

witnesses and tamper with evidence.

(iii) They shall not get involved in similar

offences during the currency of the bail period.

In case of breach of any of the bail conditions, the prosecution shall be at liberty to apply for cancellation of the bail before the jurisdictional court.
