APPLICATION FOR ANTICIPATORY BAIL

The applicants are accused Nos. 1 to 4 in Crime
No.1416 of 2020 of Hosdurg Police Station, Kasaragod, for
having allegedly committed offences punishable under
Sections 143, 145, 147, 148 read with Section 149 of the
IPC, and under Section 3(1) of the PDPP Act.The
prosecution case, in brief, is this:

2.On 24.12.2020, at about 16.30 hours, the

applicants were engaged in agitation which took place in
consequence of a murder of a party member and they
allegedly pelted stones at Police vehicles, when the
Policemen came to disburse the agitated mob. Damage to
the tune of Rs.16,000/- was caused to the police jeep in the
stone-pelting. There are no other non-bailable offences
alleged against the applicants. Under the circumstances, I

find that there is no reason for custodial interrogation of
the applicants and they are entitled to pre-arrest bail.

3.As a result, the application is allowed and the
applicants are directed to surrender before the
Investigating Officer within two weeks. In the event of their
arrest, after interrogation, and recovery, if any, they shall
be released on bail on the execution of bonds for
Rs.50,000/-(Rupees Fifty thousand only), each with two
solvent sureties, each for the like amount to the satisfaction
of the Investigating Officer and on following further
conditions:

(i)They shall deposit a sum of Rs.1,000/- each before
the jurisdictional court.

(ii)They shall appear before the Investigating Officer
as and when called for.

¶33

(iii)They shall not intimidate or influence witnesses
and tamper with evidence.

(iv)They shall not get involved in similar offences
during the currency of the bail period.

In case of breach of any of the bail conditions, the
prosecution shall be at liberty to apply for cancellation of
the bail before the jurisdictional court.
