Division Kunnamkulam as per Ext.P2. On finding that service of a more experienced hand in the note book section is necessary in the manufacturing unit, the 3rd respondent who was the Manager, note book special project, e-triveni, in the Head Office was transferred to the stationery Division, Kunnamkulam. Since the season is forthcoming, a person who is having more knowledge and experience in the section is necessary at Kunnamkulam and therefore it has become necessary to appoint the 3rd respondent at Kunnamkulam. It is submitted that the 3rd respondent is in the cadre 'Assistant Manager'. It is also relevant to note that Smt.Mary Varghese, Manager Grade I, is posted to the post of Manager, Note Book Special Project at Head Office in Sl.No.1 in Ext.P3. The said appointment was also in the Administrative exigency. The petitioner who is a Data Entry Helper, is not found suitable to be given charge of the Manager in the Head Office. It is submitted that in the LPG Plant at Palakkad, there are 35 employees working and serious difficulties are being faced on account of the fact that there is no coordinator in the said section and therefore a Co-ordinator to coordinate the function of different units therein has become necessary. The petitioner was found suitable to give charge of the said post. The business in the said unit has been increased, based on the agreement with the BPCL and IOC and therefore a Co-ordinator was absolutely essential. It is clear from the above that the transfers made as per Ext.P3 was in the administrative exigency and there is absolutely no illegality or irregularity in it. There is no arbitrariness or malafides in the issuance of Ext.P3.”
