was pointed out that the petitioner's mother, who was arrayed as the 4th respondent in O.P.No.641 of 2009, had trespassed into Valavan Thodu to the extent of 5.750 cents and therefore, action has to be initiated. The learned counsel, who represented the petitioner's mother before the Ombudsman, submitted that there is trespass of Valavan Thodu before and after the property of the 4th respondent and therefore a uniform action has to be taken. Before the Ombudsman, the Additional Tahsildar, Moovattupuzha, the 3rd respondent herein, has submitted a report. In Ext.P2 order, the Ombudsman found no justification in proceeding against only one person when there is alleged to be other trespassers also. Therefore, the Additional Tahsildar, Moovattupuzha was directed to find out the encroachments on Valavan Thodu, which run through the Elanji Grama Panchayat, with the assistance of the Taluk Surveyor, and thereafter give a report to Elanji Grama Panchayat.
