Since common issues are raised, these writ petitions are heard together and are being disposed of by this common judgment.

W.P.(C) No.19365 of 2019:- The 1^st petitioner college was conducting B.Pharm course on the strength of the approval granted by the 2^nd respondent All India Council for Technical Education and the affiliation granted by the 1^st respondent Kerala University of Health Sciences. The 2^nd petitioner is the Principal of that college. The petitioners have filed this writ petition under Article 226 of the Constitution of India, seeking a writ of certiorari to quash Exts.P5 and P7 communications issued by the 1^st respondent; a writ of mandamus commanding the 1^st respondent University to issue continuation of affiliation for the academic year 2019-20 to the 1^st petitioner college; a declaration that the 1^st petitioner college is entitled for the continuation of affiliation for the academic year 2019-20; a declaration that the 2^nd petitioner is entitled to continue as the Principal of the 1^st petitioner college; a writ of mandamus commanding the 1^st respondent University to notify the maximum

age of retirement of faculties of Pharmacy including Principal as 70

years as stipulated in Ext.P4 regulations of the 2^nd respondent; a writ of mandamus commanding the 1^st respondent University to comply with the qualifications prescribed under Ext.P4 regulations of the 2^nd respondent both under Government and private sectors; a writ of mandamus commanding the 1^st respondent University to consider and pass orders of Ext.P8 reply submitted by the 2^nd petitioner on behalf of the 1^st petitioner.

On 22.08.2019, when this writ petition came up for

admission, learned Standing Counsel sought time to get instructions. This Court granted an interim order, which reads thus :

“In the meanwhile there shall be a direction to the first respondent to grant provisional affiliation for the petitioner institution for the academic year 2019-20, provisionally and subject to further orders.”

W.P.(C) No.17813 of 2020:- The petitioner college,

which is conducting B.Pharm course, with an intake of 60 seats, on the strength of the approval granted by the Pharmacy Council of India, and affiliation granted by the 1^st respondent Kerala University of Health Sciences, has filed this writ petition seeking a writ of mandamus commanding the 1^st respondent University to issue

continuation of affiliation for the academic year 2020-21 to the petitioner college; a declaration that the petitioner college is entitled for the continuation of affiliation for the academic yer 2020-21; a writ of mandamus commanding the 1^st respondent University to consider and pass orders on Exts.P2 and P7 reply submitted by the petitioner.

A statement has been filed on behalf of the 1^st

respondent University, opposing the reliefs sought for in the writ petition. The 2^nd respondent AICTE has also filed a statement. The 3^rd respondent Pharmacy Council of India has filed counter affidavit, producing therewith Exhibits R3(a) to R3(c) documents.

W.P.(C) No.21498 of 2020:- The petitioner college,

which is conducting B.Pharm course with an intake of 60 seats, has filed this writ petition seeking a writ of mandamus commanding the 3^rd respondent Commissioner for Entrance Examination to include the name of the college in the list for allotment of students in B.Pharm course for the academic year 2020-21. The petitioner has

also sought for a writ of mandamus commanding the 2^nd respondent to issue a letter to include the name of the petitioner

college in the allotment process by the 3^rd respondent Entrance Commissioner; and a writ of mandamus commanding the respondents to allow the petitioner college to admit the students for the B.Pharm course for the academic year 2020-21, which is approved by Pharmacy Council of India.

W.P.(C) No.22841 of 2020:- The petitioner college has filed this writ petition seeking a writ of certiorari to quash Ext.P11 order of the 2^nd respondent University rejecting the application for continuation of provisional affiliation to conduct B.Pharm course for the academic year 2020-21. The petitioner has also sought for a writ of mandamus commanding the 2^nd respondent University to grant continuation of provisional affiliation for B.Pharm course, in the academic year 2020-21, considering Exts.P8 to P10; a writ of mandamus commanding the respondents to reconsider Ext.P11 rejection of affiliation in the light of Exts.P8 to P10.

On 14.10.2020, when this writ petition came up for consideration along with W.P.(C) Nos.21498 & 17813 of 2020, learned Standing Counsel for the University submitted that Dr.Jayesh V.N., Vice Principal of the petitioner College, who had

been appointed as Principal-in Charge, was not having the requisite experience and that the matter had to be placed before the Governing Council of the University, which was scheduled to meet on 17.10.2020. When this writ petition came up for consideration on 19.10.2020, along with connected matters, learned Standing Counsel for the University submitted that the Governing Council of the University met on 17.10.2020 has taken a decision to reject the application made by the petitioner college.

On 23.10.2020, when these writ petitions came up for consideration along with W.P.(C).No.13760 of 2020, the learned Standing Counsel for the University submitted that till that date, the petitioner institution has not chosen to file a proper compliance report to the deficiencies noted vide Exts.P6 and P8 in W.P.(C) No.22841 of 2020, other than Ext.P7 communication dated 05.08.2020 produced in W.P.(C). No17813 of 2020.

On 03.11.2020, when these writ petitions came up for consideration, this Court passed the following order:

“The learned Standing Counsel for the University, on instructions, would submit that the compliance report submitted by the petitioner came up for consideration

before the Scrutiny Committee on 02.11.2020 and based on the decision taken by the Scrutiny Committee, further inspection will be conducted forthwith.

The said submission made by the learned Standing Counsel is recorded.”

Today, when these writ petitions are taken up for consideration along with W.P.(C) No.13760 of 2020, the learned Standing Counsel for the University would submit that the petitioner college has already been granted continuation of affiliation for the academic year 2020-21, and that, the said fact has also been communicated to the Commissioner for Entrance Examinations.

Learned counsel for the petitioner would submit that the

petitioner institution has already been included in the Centralised Allotment Process, for the current academic year.

Having considered the submissions made by the learned counsel on both sides, these writ petitions are disposed of recording the fact that the petitioner institution has already been granted continuation of affiliation for B.Pharm course, with an intake of 60 seats, for the academic year 2020-21, and the said

fact has already been informed to the Commission for Entrance Examinations, so as to allot students in the current academic year. Since the petitioner college is granted continuation of affiliation for the academic year 2020-21 for B.Pharm course with an intake of 60 seats, the interim order dated 22.08.2019 in W.P.(C) N0.19365 of 2019, whereby the University was directed to grant provisional affiliation for the college for the academic year 2019-20, for conducting B.Pharm course with an annual intake of 60 seats, subject to further orders in that writ petition, is made absolute.
