The prayer in this writ petition is for a direction to respondents 1 and 2 to constitute a special team for the investigation of Crime No.1897 of 2020, registered at the Varkala Police Station. The crime was registered on the basis of a complaint submitted by the petitioner, alleging that, on 30.5.2020 by about 1.30 a.m., the accused had trespassed into the Ayurveda resort conducted by the petitioner at Varkala and after assaulting the petitioner's employee and tying him up, had committed theft of various electronic and other items and had also vandalized the office room. According to the petitioner, the resort was being conducted in the property taken on lease from one Sobha Nair and based on a sale agreement entered into with the said Sobha Nair, he had paid an amount of Rs.80 lakhs towards sale consideration. Since Sobha Nair failed to execute the sale deed in terms of the agreement, petitioner has preferred a suit for specific performance. The suit happened to be dismissed for default and an application for restoration of the suit is pending consideration.
