The 5th respondent is the brother of the petitioner. Certain amounts were deposited in the 4th respondent Bank, being the proceedings of a sale of property which stood in the name of the petitioner’s father and the same came to be deposited in the 4th respondent Bank in the name of Smt. Annamma, the mother of the petitioner and the 5th respondent. The petitioner contends that the 5th respondent approached the Consumer Disputes Redressal Forum, Kalpetta and filed a petition seeking release of the amount that Smt. Annamma held in the Bank. The CDRF allowed the petition and the amount was released to the 5th respondent. However, the State Commission set aside the order and the amount was ordered to be redeposited. Though the matter was taken up before the National Forum, the complaint was ordered to be withdrawn with liberty to file a fresh complaint, but with rider to redeposit the amount within a period of 30 days. The said order was not complied with by the 5th respondent, contends the petitioner. Being aggrieved, the 4th respondent moved ARC No.266 of 2018 before the 3rd respondent seeking to realise the amount from the 5th respondent. The petitioner contends that the ARC was filed as early as on 27.9.2018 and due to the pendency she is being affected prejudicially as she is the rightful claimant of the amounts. Her prayer in this petition is to direct the 3rd respondent to expedite the proceedings and take the matter to its logical conclusion at the earliest.
