JUDGMENT
After arguing this matter for sometime, Dr.K.P.Satheesan, learned senior counsel, instructed by Sri.K.Sudhin Kumar, appearing for the petitioner, sought permission to withdraw this writ petition, with liberty to approach a competent Civil Court for the reliefs sought for herein.
Sri.K.Anand, learned senior counsel, instructed by Smt.Latha Anand, appearing for the first respondent Bank did not oppose the request for withdrawal of this writ petition but prayed that this Court may not reserve liberty to the petitioner to invoke any other remedy, asserting that if any such is available to him, he does not require the permission of this Court.
Taking note of the afore submissions and finding some force in the submissions of Sri.K.Anand, I close this writ petition as having been withdrawn; making it clear that this Court has not entered into the merits of any of the contentions of the rival parties and thus leaving open all remedies as are available to them as per law.
