JUDGMENT
When there is disputed title and identity of property, is it permissible to grant a blanket injunction against trespass without adjudicating disputed title and identity of the property is the question came up for consideration in this appeal.

without substantial prayers. Ext.A9 letter alleged to have been issued by the defendant also relied on by the plaintiff. When there is a dispute regarding the identity of the property and the title, a mere suit for injunction simplicitor
against trespass will not stand. No blanket
injunction can be granted without adjudicating the identity of the property and disputed title. The decree and judgment of both the courts below are liable to be set aside without prejudice to the right of the plaintiff to institute a fresh suit curing the defect by incorporating substantial prayers.
The decree and judgment of both the courts
below are hence set aside and the suit is dismissed by allowing this appeal. No costs.
