the petitioner and on the basis of the promise to marry she had sex with the petitioner. Subsequently the petitioner retracted from the promise. She left the organization in October, 2017. The First Information Statement was filed after nine months in June, 2018. thus the allegation itself is only an afterthought. The petitioner as well as the de facto complainant are majors and they had consensual sex. It is not a punishable offence. The petitioner is employed abroad. His mother is suffering from cancer and his sister's wedding is already fixed. Hence, the presence of the petitioner at his house is highly essential. The petitioner apprehends that he may be arrested by the police if he comes to India. Thereupon, the petitioner filed an application for anticipatory bail as B.A.No.1351/2020. The petitioner is abroad and unless he files an appli9cation after coming to India, the application for anticipatory bail cannot be considered. Accordingly, the bail application is kept pending as 'post when moved again'. The entire allegations are false and baseless. Even if, the trial is conducted there is no possibility for conviction. The proceedings is a sheer waste of time. It is in the light of these averments and contentions, that the petitioner has filed the instant Crl.M.C under Sec.482 of the Cr.P.C with the aforementioned prayers.
