This is an application seeking anticipatory bail filed under Section 438 Cr.PC.

Applicant is the third accused in Crime No.396/2020 of Kollam East Police Station for having allegedly committed offences punishable under Section 394 IPC, along with two others.

The prosecution case, in brief, is that on 3.3.2020 at about 11.30 p.m. at Vadakubhagom, the applicant in furtherance of common intention with the other two accused commuting on a scooter bearing Regn.No.KL-2-BF-1967, restrained the de facto complainant, attacked and assaulted him and thereafter robbed him of his mobile phone worth Rs.15,000/- and Rs.700/- cash, in consequence of which the crime was registered. Accused 1 & 2 were already arrested. The applicant also apprehends arrest and has therefore approached this Court seeking anticipatory bail.

Considering the gravity of the offence and the fact that the applicant has six other criminal cases registered against him as antecedents, I find that this is not a fit case where the extraordinary remedy of anticipatory bail can be exercised in his favour. Hence, the bail application is disposed of with a direction to the applicant to surrender before the investigating officer within two weeks. In the event of his being arrested, after interrogation

and recovery, if any, he shall be produced before the jurisdictional court, where he is at liberty to apply for regular bail, which shall be considered and preferably disposed of by the jurisdictional court on the very same day.
