The applicants apprehend arrest in an unknown crime for a non-bailable offence purportedly registered in the Police Station at North Paravur. The learned Public Prosecutor under instructions submits that no crime has been registered at the North Paravur Police Station, against the applicants for a non-bailable offence. Hence, the apprehension of arrest is misplaced.
The application is, therefore, disposed of, with a direction to the SHO, North Paravur Police Station, not to arrest the applicants until they are served with a notice under Section 41A Cr.P.C, in case, a crime is registered in that Police Station for a non-bailable offence.
