The sole defendant in O.S. No.74/1997 challenges the impugned judgment and decree passed by the Subordinate Judge, Palakkad allowing the plaintiff to recover an amount of Rs.2,16,150.72 with interest.

for an amount of Rs.2,13,483.64 and agreed to discharge the same forthwith. But since he failed to discharge the liability as undertaken, the plaintiff filed the suit claiming the amount with interest.

demanding his signatures in the documents making him believe that he was to leave for Indonesia soon, where he was employed and had no time to spend. The appellant was not given opportunity to go through the records and he subscribed signatures to the documents believing that they were not finally prepared. It is, therefore, contended that Exts.A5 to A7 are vitiated by fraud and not binding on him. He also contended that the facts and figures arrived at in Exts.A6 and A7 are against facts and the liability of the Firm was not correctly ascertained as per the true records.

as a reasonable prudent person, he was bound to have read and understood the contents of the

documents brought to him before subscribing his signatures. His contention that he did not get sufficient opportunity does not appeal to common sense. If at all plaintiff made a hurry burry and tried to make a false impression also, it was up to him to have read and understood the contents of the documents before accepting them. He has no case that the documents brought before him were blank or unfilled. In my opinion, there is reason to think that the defendant accepted his liability after going through the relevant records and ascertaining the true financial position of the Firm.
on re-appreciating evidence, there is no reason to reject their evidence. On evaluating the entire

materials on record and after considering the submissions made by the learned counsel appearing on both sides, I do not find sufficient ground to interfere with the findings entered into by the court below that the appellant is bound to discharge the liability undertaken by him as per Exts.A5 to A7 documents. The impugned judgment and decree in O.S. No.74/1997 are liable to be confirmed.
In the result, appeal fails and it is
dismissed.
All pending interlocutory applications will stand closed.
