JUDGMENT
Sri. M. Kiranlal, the learned counsel appearing for the petitioner would submit on the basis of instruction of his party that the petitioner has now been advised that since the birth of the minor child has not been registered within one year, then permission will have to be obtained by an order to be passed by the empowered Magistrate like the Revenue Divisional Officer as envisaged in Section 13(3) of the Registration of Births and Deaths Act, 1969 and that leave may be granted to the petitioner to withdraw this writ petition so as to file a proper application before the empowered Magistrate like the Revenue Divisional Officer under Section 13(3) of the Act seeking orders and then to initiate appropriate proceedings, if so required.
In the light of the above said submission made on behalf of the petitioner, the above writ petition will stand dismissed as withdrawn with the above said liberty .
