Petitioner is the owner of an extent of 79.944

¶22

Ares of property situate in Re.Sy.No.71/11 of Kottooli Village, Kozhikode District. According to the petitioner, the property is remaining as garden land, however, the same is included in the data bank

constituted as per the provisions of Kerala Conservation of Paddy Land and Wetland Act, 2008. Thereupon, petitioner has now submitted Ext.P7 application before the 5^th respondent seeking removal of the property from the data bank and seeks direction for early consideration of the same.

I have heard learned counsel for petitioner,

learned Government Pleader and perused the pleadings and documents on record.

Learned Government Pleader pointed out that

Ext.P7 application is incomplete in all respects. In

that view of the matter, liberty is given to the

¶29

petitioner to submit a properly constituted application before the 5^th respondent within three weeks from the date of receipt of a copy of this judgment, which if received shall be considered in

accordance with law and attain finality within three

months from the date of receipt of the fresh

application.
